Earlier this year, the NSW Independent Liquor and Gaming Authority (the Authority) updated Guideline 16, which governs the way in which it assesses applications that increase access to post-midnight gaming. The Guideline formerly applied to any application that, if approved, would result in increased availability of gaming machines after 12 midnight at a venue located in a Band 3 SA2, or after 2am at any venue. Now, it applies to any application that, if approved, would result in increased availability of EGMs after 12 midnight at any venue.
The Vibrancy Reform package passed by NSW Parliament in December 2023 include diverse changes applicable to many types of licensed businesses, with many gradually coming into effect throughout 2024. Licenced businesses can expect these changes to wholistically deliver a more favourable regulatory environment which creates greater operational certainty, particularly for those providing live music or special events.
The temporary provisions introduced during COVID-19 regarding approval for outdoor dining have been made permanent under the State Government’s recent Vibrancy Reform package. This means that the previously approved area will continue to be licensed while the land use remains an exempt development. However, businesses should note that any changes to the outdoor dining area require a new application to be lodged with Liquor & Gaming NSW.

It is important to consider the steps to be taken when a licensed business ceases to trade. As one example, BSV acts for a licensee who closed their bottleshop at the end of their lease when the business vacated the tenancy. The required Cease to Trade Form was lodged with the NSW Liquor and Gaming, advising that Department the packaged liquor licence had ceased business operations and was now dormant.
The NSW Government has announced funding for 5,000 free RSA courses for new entrants and is encouraging former hospitality staff to return to the sector by offering free refresher courses to those with an RSA competency card that has expired since 1 February 2020 or will expire before 30 June 2022.

As at 17 November 2020 the Liquor Amendment (24-hour Economy) Bill 2020 passed through both Houses of Parliament and awaits assent. The Legislation is expected to take effect from 1 December 2020.
The Bill was introduced in May as a part of the NSW Government initiative which sees a prioritisation of Sydney’s 24-hour Night-Time Economy.

Annual Licence Fees
Due to the impact of COVID-19 on the liquor and hospitality industry, the NSW Government has announced that it will waive most annual licence fees for the 2020-2021 fee period.
The base fee and trading hours risk loading fee that normally applies to liquor licences will be waived. However, the compliance risk loadings that might also apply to a liquor licence will remain, but those fees will be deferred and included in the 2021-2022 fee period.

The licence means that Cali Press can now serve wine and cocktails alongside its offering of healthy wholefood meals, smoothies and juices to diners in Randwick.
This statement sets out the enforcement approach that Liquor & Gaming NSW will take to compliance with certain specified requirements as set out under the Liquor Act 2007, the Gaming Machines Act 2001, Liquor Regulation 2018 and Gaming Machines Regulation 2019 in response to the COVID-19 pandemic.

On 1 September 2018 the Liquor Regulation 2018 (2018 Regulation) replaced the Liquor Regulation of 2008. Like the 2008 Regulation, the 2018 Regulation prescribes matters necessary for the effective operation of the Liquor Act 2007 (the Act) and introduces key changes to support responsible industry development while continuing to prioritise harm minimisation.

The NSW Government has introduced the most significant changes to gambling regulation in NSW for more than a decade. The changes follow extensive community and industry consultation. For the most part the changes address issues in relation with gambling harm mostly by providing more regulation and oversight for areas considered to have an elevated risk.

The NSW 2007 Liquor Act does not permit a liquor licence to be granted without development consent or approval. The IL&GA are now advising applicants to submit a copy of their consent or approval at the time the liquor application is lodged. Applications that are lodged without the relevant consent or approval will be deemed incomplete, and the application will not be processed. Consequently, the 30-day submission period will not commence until the consent or approval has been lodged. Further, only at that time will the details of the application be uploaded to the OLGR’s public noticeboard.

Beyond the Label will sell premium and boutique wines and feature state of the art wine dispensing machines using smartcard technology. The NSW Government has announced details of the new periodic risk-based liquor licence fees payable by each licensee. The model comprises a base fee plus risk-based loadings, with the scheme commencing 1 July 2014. Licensees can lower the amount payable by maintaining a safe, low risk operation. NSW liquor laws require a licensee to lodge a return containing key information about their liquor licence every second year. The current return is due by 31 March 2014 and is for the two-year period from 1 January 2012 to 31 December 2013.
A total of 63 'strikes' have now been recorded against 60 licensed premises under the Three Strikes disciplinary scheme for serious offences under the Liquor Act, including three second strikes by venues. More venues were recently added to the public register of strikes
